Full list of Protected Industrial Actions in place from 21st April

 1. An unlimited number of bans for an indefinite period on 1500V DC switching, except in emergencies to prevent serious and imminent hazards to employees or the public;
2. An unlimited number of bans for an indefinite period on authorising non Sydney Trains employees as the holder(s) of WHVI’s (working high voltage instructions) or 1500 Volt Authorities;
3. An unlimited number of bans for an indefinite period on checking and approving 1500V Authorities and Working High Voltage Instructions (WHVI) with less than two (2) weeks’ notice, except in emergencies to prevent imminent hazards to employees or the public;
4. An unlimited number of bans for an indefinite period on ICON Electrical employees amending 1500V Authorities and Working High Voltage Instructions (WHVI), except in emergencies to prevent imminent hazards to employees or the public;
5. An unlimited number of bans for an indefinite period on reclamation of parts from rolling stock;
6. An unlimited number of bans for an indefinite period on the installation of reclaimed parts in rolling stock;
7. An unlimited number of bans for an indefinite period on using locking systems, whether mechanical or digital, other than locking or unlocking a motor vehicle, except in emergencies to prevent imminent hazards to employees or the public;
8. An unlimited number of bans for an indefinite period on labour costing; and
9. An unlimited number of bans for an indefinite period on accessing or making entries in a rostering system.
10. An unlimited number of bans for an indefinite period on performing High-Voltage Switching, except in emergencies to prevent imminent hazards to employees or the travelling public;
11. An unlimited number of bans for an indefinite period on work at sites that do not have separate amenities for both male and female employees, except in emergencies to prevent imminent hazards to employees or the travelling public;
12. An unlimited number of bans for an indefinite period bans on attending to call outs during a fatigue break, except in emergencies to prevent imminent hazards to employees or the travelling public;
13. An unlimited number of bans for an indefinite period bans on the performance pre-departure checks on trains;
14. An unlimited number of bans for an indefinite period bans on working on systems, equipment or infrastructure maintained by contractors (third party service provider or maintainer) under a current maintenance contract, except in emergencies to prevent imminent hazards to employees or the travelling public;
15. An unlimited number of bans for an indefinite period bans on providing remote access to contractors and third parties not employed by Sydney Trains;
16. An unlimited number of bans for an indefinite period bans on working with people who are not Sydney Trains direct hire employees;
17. An unlimited number of bans for an indefinite period bans on the use of vehicles (excluding plant and equipment) provided by Sydney Trains. NB The vehicle ban is subject to a Safety Commitment, see below;
18. An unlimited number of bans for an indefinite period on work on capital works projects;
19. An unlimited number of bans for an indefinite period bans on the use of communications technology such as mobile phones, tablets and radios in the rail corridor, except in emergencies to prevent imminent hazards to employees or the travelling public;
20. An unlimited number of bans for an indefinite period on the performance of computer and digital work in the nature of labour costing, rostering, reporting and data-logging; except in emergencies to prevent serious and imminent hazards to employees or the travelling public
21. An unlimited number of bans for an indefinite period bans on performing work which is subject to protected action bans by any or all of RTBU, APESMA, AMWU, CFMMEU, AWU, or ASU members;

Work Practice Bans


22. Members will for an indefinite period attach union and industrial campaign-related material to outgoing mail and/or emails and add CEPU and industrial campaign-related material to Sydney Trains materials and displays.
23. Members will for an indefinite period speak to members of the public during work related telephone calls about the industrial action and the CEPU’s campaign for a new enterprise agreement.
24. Members will for an indefinite period wear and distribute CEPU and industrial campaign-related material to members of the public whilst performing work, including but not limited to t-shirts, badges, written communications and stickers.
25. Members will for an indefinite period provide information, in any form, concerning the views of employees about industrial action and the CEPU’s campaign for a new enterprise agreement to members of the community including to members of the media.

Safety Commitment: Protected Industrial Action: Vehicle Use


The CEPU will take reasonable steps to advise its members that they should continue to use vehicles provided by Sydney Trains for the following purposes: 
While an employee is rostered on-call the employee shall continue to use their Sydney-Trains provided vehicle to attend and perform any call-out to perform work
Any employee directed to engage in incident response work shall continue to use their Sydney Trains provided vehicle for the purpose of attending to that work and while engaged in that work
Any employee who has been provided with a vehicle for take-home use by Sydney Trains shall use their Sydney Trains provided vehicle for transit to and from their designated depot for the commencement of their shift or at the conclusion of their shift if so directed
Further to the above, any employee who is reasonably directed to use their Sydney Trains provided vehicle for the purpose of responding to an emergency that presents an imminent risk to health and safety shall follow that direction.
